1. About This Policy
This Text Messaging / SMS Policy (“SMS Policy”) explains how Denver Oculoplastics, PLLC, a Colorado professional limited liability company, doing business as For Men – Oculoplastics & Aesthetics (the “Practice,” “we,” “us,” or “our”), uses text messaging in connection with the Website at menconfident.com and our services. It applies to text (SMS/MMS) messages sent to or from the Practice. This SMS Policy is part of, and is incorporated by reference into, our Terms of Use and works together with our Privacy Policy.
We text from (720) 443-2403 (our men’s campaign / text line). Our texting program is operated using a standard 10-digit local phone number — not a short code.
2. Program Description
If you provide your mobile number, submit a Website form, call or text the Practice, request a consultation, or otherwise consent, the Practice may send text messages related to:
- responding to consultation or contact requests;
- scheduling and coordinating appointments;
- appointment reminders and confirmations;
- basic logistical follow-up related to your request or visit; and
- promotional and marketing messages about office availability, events, services, and offers.
3. Your Consent
By providing your phone number and checking the Website consent box, you authorize the Practice to contact you by phone, email, or text about scheduling and consultation follow-up, and to send you promotional and marketing text messages about availability, events, services, and offers, at the number you provide. By giving that consent, you agree we may send recurring service and promotional text messages.
You represent that you are at least 18 years old and that you are the account holder for that number, or an authorized user with permission to receive text messages on it. Please do not provide a number that is not yours or that you are not authorized to use.
4. Marketing-Text Consent Is Not Required for Services
Consent to receive promotional or marketing text messages is not a condition of receiving any service from the Practice. You do not have to agree to texts to request a consultation, schedule, or receive care. If you prefer not to agree to text messages through the Website form, you may contact the Practice by phone instead at (720) 443-2403 or (720) 699-8687.
5. Message Frequency
Message frequency varies and may depend on your inquiry, appointment status, scheduling activity, promotions, events, availability, and your communication preferences. You may receive more messages around the time of a request or an appointment, and fewer at other times.
6. Message and Data Rates
Message and data rates may apply to texts you send to or receive from us, depending on your mobile plan and carrier. We do not charge a separate fee for our texts, but your carrier’s standard rates may apply. Please check with your mobile carrier if you have questions about your plan.
7. How to Opt Out (STOP)
You can opt out of text messages at any time by replying STOP to any of our text messages. After you send STOP, we will send a one-time confirmation message, and then we will stop sending text messages to that number unless you later opt in again or otherwise provide consent.
Effect of opting out. Replying STOP stops all of our text messages to that number. It does not cancel appointments, end treatment, opt you out of phone calls or emails, or prevent communications required or permitted by law. If you are a patient, important healthcare, billing, scheduling, or administrative communications may still need to occur through other methods, such as phone or email, using the contact information and preferences you have provided. To opt back in later, you can text us again or let us know your updated preferences.
8. How to Get Help (HELP)
For help, reply HELP to any of our text messages, or contact us at (720) 443-2403 or privacy@themensproject.com. Replying HELP will provide basic information about the program and how to reach us.
9. No Emergency Use
Do not use text messaging for medical emergencies or urgent medical issues. Texts are not monitored continuously. If you have a medical emergency, call 911 or go to the nearest emergency room. If you have an urgent eye problem, surgical complication, severe pain, sudden vision change, infection concern, or other urgent medical issue, contact an appropriate medical provider immediately or seek emergency care. For urgent but non-emergency concerns, contact your physician or seek prompt in-person care.
10. Do Not Send Sensitive Medical Information by Text
Text messaging may not be secure and should not be used to send sensitive personal health information. Please do not text detailed medical history, diagnoses, medications, treatment records, photographs of medical conditions, insurance information, Social Security numbers, payment card information, urgent symptoms, or emergency concerns. Please keep texts to scheduling and general logistics.
11. No Medical Advice by Text
Text messages are not a substitute for medical advice, diagnosis, treatment, or emergency care. No diagnosis, treatment recommendation, medical advice, or provider-patient relationship is created by exchanging text messages, unless and until the Practice provides care through an actual consultation or established care relationship. 12. Privacy and Data Use
Information related to your text messages may include your phone number, message content, message timing, opt-in and opt-out records, delivery status, and related technical information. We may use SMS vendors, communications vendors, scheduling tools, CRM tools, website administrators, technical service providers, and other service providers to send, receive, route, store, or manage text messages.
Our use of text-related information is described in our Privacy Policy. Protected health information and medical records maintained by the Practice as a healthcare provider are governed by the Practice’s separate HIPAA Notice of Privacy Practices, available from the Practice upon request, and not by this SMS Policy or the Website Privacy Policy.
13. Carriers Are Not Liable
Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to your carrier, device, network, SMS vendor, and other technical factors, and is not guaranteed.
14. Eligibility
The text messaging program is intended only for adults 18 years of age or older. Do not opt in or provide a phone number if you are under 18.
15. Changes to This SMS Policy
We may update this SMS Policy from time to time. When we do, we will revise the “Last Updated” date above and post the updated SMS Policy on the Website. Changes are effective when posted.
