1. About These Terms and Who We Are
This website, located at https://menconfident.com and any related landing pages, forms, features, and online content (the “Website”), is owned, controlled, and managed by Denver Oculoplastics, PLLC, a Colorado professional limited liability company, doing business as For Men – Oculoplastics & Aesthetics (the “Practice,” “we,” “us,” or “our”).
These Terms of Use (“Terms”) are a legal agreement between you and the Practice. They explain the rules for using the Website. Please read them carefully. These Terms work together with our Privacy Policy and our Text Messaging / SMS Policy, each of which is incorporated into these Terms by reference.
2. Acceptance of These Terms
By accessing or using the Website, submitting a form, clicking a checkbox, requesting contact, or communicating with us through the Website, you agree to these Terms, our Privacy Policy, and our Text Messaging / SMS Policy. If you do not agree, please do not use the Website or submit information through it.
3. Who the Website Is For — Colorado Adults 18+
The Website is intended only for adults 18 years of age or older who are located in the State of Colorado or who are seeking care from the Practice in Colorado.
The Website and the services described on it are directed to Colorado patients and prospective patients. To the fullest extent permitted by law, we make no representation that the Website, any service, or any communication is appropriate, available, or permitted for use outside Colorado, and we disclaim responsibility for any person who accesses the Website or submits information from outside our intended Colorado service area. If you access the Website from outside Colorado, you do so at your own initiative.
If you are under 18, please do not use the Website or submit any information through it.
4. The Website Is Informational and Marketing-Oriented Only
The Website provides general information about the Practice and the oculoplastic, ophthalmology-related, reconstructive and cosmetic eyelid/face, non-surgical aesthetic, men’s aesthetic, and body-composition-related services we may offer, along with scheduling options and consultation availability. It exists for general information and marketing purposes. The Website is not a patient portal, a medical intake portal, a telemedicine platform, or an emergency communication system.
5. No Medical Advice
The content on the Website — including text, descriptions of services, frequently asked questions, and any other materials — is for general informational purposes only. It is not medical advice and is not a substitute for professional medical evaluation, diagnosis, or treatment.
Website content may not apply to your individual medical history, anatomy, skin type, eye condition, medications, health status, goals, or risk factors. Aesthetic and medical treatments are not appropriate for everyone, results vary, and no outcome is guaranteed. Medical advice is provided only through an actual consultation or an established care relationship with a licensed provider. Always seek the advice of a qualified health provider with any questions you have about a medical or aesthetic concern.
6. No Physician-Patient Relationship Is Created
Viewing or browsing the Website, submitting a form, receiving a reply, exchanging emails or text messages, calling the Practice, or requesting a consultation does not create a physician-patient, provider-patient, or any other treatment relationship between you and the Practice.
A physician-patient relationship is created only when the Practice accepts you as a patient and provides care through an actual consultation or established care relationship, consistent with applicable law and our professional obligations.
7. Emergencies and Urgent Medical Issues
Do not use the Website, any form, email, text message, voicemail, or social media for medical emergencies or urgent medical issues. The Website and our communication tools are not monitored continuously and are not appropriate for emergencies.
If you are experiencing a medical emergency, call 911 immediately or go to the nearest emergency room. If you have an urgent eye problem, surgical complication, severe pain, sudden vision change, infection concern, or other urgent medical issue, contact an appropriate medical provider immediately or seek emergency care. For urgent but non-emergency concerns, contact your physician or seek prompt in-person care.
8. Forms Are Consultation Requests Only
Any contact or “request a consultation” form on the Website is a request for scheduling contact only. Submitting a form does not book an appointment and does not guarantee an appointment, consultation, procedure, treatment, provider availability, price, promotion, result, or candidacy for any service. We may contact you by phone, email, or text to discuss scheduling, consultation availability, and related logistical follow-up. Appointments, candidacy, treatment options, pricing, and the risks and benefits of any treatment are addressed during a consultation, not through the Website.
9. Do Not Submit Sensitive Medical Information Through Public Forms
Public Website forms are intended to collect only minimal lead-generation information — such as your name, email, phone number, preferred contact method, service interest, and an optional short note.
Please do not submit sensitive medical information through any public Website form, by email, or by text message. This includes detailed medical history, diagnoses, medications, treatment records, photographs of medical conditions, insurance information, Social Security numbers, payment information, or urgent medical concerns. These channels are not secure and are not intended for sensitive health information.
If you voluntarily submit health information through a public form despite this warning, the Practice will handle that information in accordance with applicable law and our internal policies. However, public Website forms are not designed or intended for sensitive medical information.
How protected health information and medical records are handled is described in the Practice’s separate HIPAA Notice of Privacy Practices, which is available from the Practice upon request and may be provided at or before your first clinical encounter. The Website Privacy Policy governs general website data and does not replace the HIPAA Notice of Privacy Practices.
10. Accuracy of Website Content
We try to keep the Website accurate and current, but we do not guarantee that all content is complete, current, error-free, or suitable for your specific circumstances. Website content may contain errors or omissions. Services, availability, technology, pricing, promotions, scheduling options, providers, procedures, risks, recovery times, and expected outcomes may change without notice.
11. Results, Candidacy, and Treatment Information
Any descriptions of services, results, benefits, downtime, or outcomes are general only, and results vary. No treatment is guaranteed, risk-free, painless, appropriate for everyone, or certain to produce a particular outcome. Candidacy, risks, benefits, alternatives, expected results, and aftercare must be reviewed with the Practice during a consultation or established care relationship. Before-and-after images, testimonials, examples, or marketing statements, if any, are not promises of your result.
12. Appointments and Scheduling
Appointment requests are not confirmed until the Practice confirms them. The Practice may decline, reschedule, modify, or cancel appointments as appropriate, and specific providers, services, appointment times, off-hours availability, and promotional availability are not guaranteed. We are not responsible for missed communications, scheduling delays, or reliance on an appointment that has not been expressly confirmed. Separate Practice policies may apply to deposits, cancellations, late arrivals, no-shows, financing, payment, consent forms, pre- and post-procedure instructions, and medical records.
13. Promotional Information
The Website and our communications may describe promotions, availability, events, services, or offers. Promotional information may be limited, may expire, may be changed or withdrawn, and may be subject to clinical eligibility, scheduling availability, and additional terms. It is provided for general marketing purposes, is not medical advice, and does not guarantee that any treatment is appropriate for you.
14. Text Messaging and Email Communications
If you provide your phone number or email address, you authorize the Practice to contact you as described in our Privacy Policy and Text Messaging / SMS Policy. Text messaging and email may not be secure; do not send sensitive medical information by text or email unless the Practice instructs you through an appropriate process. You represent that you are the account holder or an authorized user of any phone number or email address you provide.
15. Website Availability
We do not guarantee that the Website will always be available, uninterrupted, secure, or error-free. The Website may be unavailable because of maintenance, updates, hosting issues, technical problems, third-party outages, cyber events, or other factors outside our control. We may modify, suspend, or discontinue any part of the Website at any time. We are not responsible for any loss or inconvenience resulting from Website downtime or unavailability.

These service providers are not healthcare providers. They do not provide medical advice, diagnosis, or treatment, and they do not own or control the Practice’s medical content. Except to the limited extent required by applicable law or by their separate written agreements with the Practice, such service providers are not responsible for Website content, medical services, treatment decisions, communications with users, privacy practices, Website downtime, data incidents, or other claims relating to the Website. We are not responsible for third-party websites, tools, content, security, availability, or privacy practices, and a link does not mean we endorse them. Use third-party websites or tools at your own risk. Your relationship for all medical and treatment matters is with the Practice.

The Website and its content — including text, layout, graphics, images, logos, icons, branding, design, videos, and forms — are owned by or licensed to the Practice or its licensors and are protected by copyright, trademark, and other laws. You may view and use the Website for your own personal, non-commercial purpose of learning about and contacting the Practice. You may not copy, reproduce, modify, distribute, scrape, frame, mirror, republish, sell, or exploit Website content, or use our names, logos, or trademarks, without our prior written permission, except as allowed by law.

You agree to use the Website only for lawful purposes and not to:

19. Information You Submit
You are responsible for the information you submit through the Website. You agree that the information you provide will be accurate, current, and submitted by you or with proper authorization (including any phone number or email address, which must be your own or one you are authorized to use). You should not submit information that is unlawful, threatening, defamatory, harassing, obscene, invasive of privacy, infringing, false, or otherwise inappropriate. The Practice may decline to respond to or act on submissions that appear incomplete, inappropriate, outside the intended service area, or unrelated to the Practice’s services. To the fullest extent permitted by law, the Website and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied. We disclaim all warranties, including warranties of accuracy, completeness, reliability, availability, merchantability, fitness for a particular purpose, title, non-infringement, and security. We do not warrant that the Website will be accurate, reliable, secure, uninterrupted, or free of errors or harmful components. Nothing in these Terms limits any professional duty or obligation, or any warranty or right, that cannot be limited or excluded under applicable law, and this Section does not apply to the actual professional services you may receive from the Practice under a care relationship.
21. Limitation of Liability
To the fullest extent permitted by law, Denver Oculoplastics, PLLC and its owners, physicians, providers, members, managers, employees, contractors, agents, and representatives, together with its website administrators, hosting providers, hosting account owners, technical service providers, plugin providers, analytics providers, advertising providers, and email and SMS communications vendors, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, goodwill, or profits, arising out of or relating to your use of (or inability to use) the Website, its content, any forms, or any Website communications, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for all claims relating to the Website will not exceed the amount you paid, if any, to access the Website.
These limitations apply to claims based on the Website and Website-related communications. They are not intended to, and do not, limit any rights or remedies you may have relating to the actual medical or professional services the Practice provides to you under a care relationship, or to waive any liability that cannot be limited under applicable law, including any applicable Colorado law governing healthcare providers.
22. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Denver Oculoplastics, PLLC and its owners, physicians, providers, members, managers, employees, contractors, agents, and representatives, together with its website administrators, hosting providers, hosting account owners, technical service providers, plugin providers, analytics providers, advertising providers, and email and SMS communications vendors, from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your misuse of the Website, your violation of these Terms, your violation of any law, or your submission of unauthorized, false, or inappropriate information.
23. Governing Law, Venue, and Dispute Resolution
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules.
Informal resolution first. If you have a concern or dispute relating to the Website or these Terms, please contact us first using the information in Section 25 so we can try to resolve it informally. Your notice should describe the issue, the relief requested, and how to contact you. We ask that you give us at least thirty (30) days to address your concern before starting any formal proceeding. This informal process does not apply where immediate court action is necessary to protect rights, prevent harm, or comply with legal deadlines.
Courts. If a dispute relating to the Website, these Terms, the Privacy Policy, or the Text Messaging / SMS Policy cannot be resolved informally, it will be brought exclusively in the state courts located in the City and County of Denver, Colorado, or in the United States District Court for the District of Colorado, and you and the Practice consent to the personal jurisdiction of those courts, unless applicable law requires otherwise.
24. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above and post the updated Terms on the Website. Changes are effective when posted. Your continued use of the Website after changes are posted means you accept the updated Terms.
